If this was a single source contract, explain why the agency determined there was only a single source for the services (if applicable) After strategically evaluating different potential expert witnesses for this matter, the AGO determined that Contractor is the best suited for this particular litigation, among a list of potential national experts. This determination takes into consideration the unique qualifications of Contractor, Contractor’s background and experience as an expert witness in litigation related to disability services, and Contractor’s past experience administering disability services in South Dakota, and the limited field of national experts on this topic. An RFP would be inappropriate for this work because it would reveal attorney-client privileged information to the public and undermine litigation strategy.
