Parcel 207 is a very large retirement (assisted living) community located in the southeast quadrant of Highway 169 and Interstate 494 in the city of Bloomington. The facility offered various levels of medical care and had a 2011 assessed value of approximately $40,000,000. MnDOT acquired a small tract of land located in the northwest corner for the new interchange. Other than minor site improvements, no structures were acquired. Access to and from Highway 169 was closed to Highwood Drive. Since the main entrance to the facility was along Highwood Drive, the owners claimed the entrance should be shifted to Marth Road (north aspect). Due to the internal circulation change, severance to the entire facility was claimed. A commissioner hearing resulted in an award in excess of $3,000,000. Both the property owner and MnDOT appealed. A jury trial was anticipated. MnDOT hired the engineering firm of Sebesta Blomberg to evaluate these several issues. The Sebesta report helped with the subsequent mediation settlement.
