DPS BCA required technical services to perform the following tasks as they related to legal challenges to the source code of the Intoxilyzer 5000EN. Phase 1 involved having an expert on retainer to consult with the State and respond to any questions that may arise during the Intoxilyzer 5000EN source code review completed by any defense counsel's expert. Phase 2 involved having the expert contractor evaluating and analyzing any issues raised by defense counsel's expert's evaluation of the Intoxilyzer 5000EN breath -alcohol testing instruments. Phase 3 involved having the expert on retainer to respond further on issues and offer court testimony as needed.
